An American flag flapping in the breeze is apparently too much for a Fargo, North Dakota HOA.
Andrew Almer has flown the flag from his second floor balcony for two years with no issue… until now. Two months ago, the president of his HOA started mailing him to take the flag down because it’s too noisy.
Almer’s response was “You’ve got to be kidding me! With everything that’s going on in the world these days and this is what you’re going to complain about?”
The Federal Freedom to Display the American Flag Act of 2005 is an Act of Congress that prohibits condominium associations and real estate management organizations from restricting homeowners from displaying the U.S. flag on their property. The exception is if there’s substantial harm to the community.
Amler says despite any fines, the flag will continue to fly.
